General Terms and Conditions of Sale

Article 1 :

These terms and conditions are concluded between, on the one hand, Catherine ALBERT, registered with the RCS of Angoulème under number 513 507 095 and located in Cognac, 49 rue Briand Boutillier, 16100 Cognac, and on the other hand, persons wishing to make a purchase via the website of La Brocante du Chrétien https://www.brocante-du-chretien.fr

Micro Enterprise • VAT not applicable (Art. 293 B of the French Tax Code)

If a condition were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector whose companies have their registered office in France.

Article 2 :

The purpose of these terms and conditions is to define the terms and conditions of sale between Catherine ALBERT - La Brocante du Chrétien and the user, from the order to payment and shipping. Any order must be placed prior to consulting these general terms and conditions of sale.

The User is advised to save and/or print these general terms and conditions without, however, modifying them.The user who places an order via this website expressly and unreservedly accepts all of these general terms and conditions. Placing the order is equivalent to acceptance.

These terms and conditions only apply to natural persons who are not merchants within the meaning of the Consumer Code and who are acting for their personal needs.



Article 3: The order

The user has the option to place their order online from the online catalogue. Prices are indicated in euros, they do not take into account delivery costs, invoiced extra, and indicated before the validation of the order, payable at the time of the order by:

- Bank cheque: Your order is then reserved for 7 days. After this period, if you do not receive your cheque, it will be cancelled.

The order will only be processed upon receipt of your cheque and after validation.

-Bank card:
The payment is made on the secure bank server of our partner PayPal Prestashop Checkout. This means that no banking information about you is transmitted via the La Brocante du Chrétien website. Payment by credit card is therefore perfectly secure; This is why you are asked for them again with each new transaction on our site. Your order will be registered and validated as soon as the payment is accepted by the bank.

-wire transfer: The order will be processed when the amount of the transfer is credited to the bank account of the Brocante du Chrétien.

Article 4: The price

Prices are quoted in euros and are only valid on the date the purchase order is sent by the consumer. They do not take into account delivery costs, which are invoiced extra, and indicated before the order is validated. Payment of the price must be made at the time of ordering. At no time can the sums paid be considered as deposits or deposits.

Article 5: Availability and warranty of products

The order will be processed no later than two days from the date of payment of the order. In case of damage or loss, the user will be informed as soon as possible and will have the option of cancelling their order. The user will have the choice either to request a full refund of the sums paid within thirty days at the latest, or to exchange them for another object from our catalog of the same value.

The products are second-hand goods, they are sold in the condition described in the product detail sheet, they are not guaranteed.

Article 6: Order Confirmation

The contractual information will be confirmed by email after validation and confirmation of the purchase order.

Article 7: Delivery

The products will be delivered to the delivery address you provided during the ordering process. However, the user may, at his request, obtain the sending of the invoice to the billing address and not to the delivery address by validating the option provided for this purpose on the order form.

The buyer or recipient of the parcel is delivered to their home or to the address of their choice by post. In the event of absence, the Buyer or recipient of the parcel will receive a notice in their mailbox from their postman, which allows them to collect the parcel from the nearest post office within fifteen days. After this time, the package is returned to La Brocante du Chrétien which will refund within 30 days directly the amount of the item(s) without the initial delivery costs. La Brocante du Chrétien reserves the right to no longer accept orders from the responsible customer. 

Article 8: Delivery errors

The user must submit to Brocante du Chrétien, on the same day of delivery or at the latest on the first working day following delivery, any claim of delivery error and/or non-conformity of the products in kind or quality with respect to the indications on the order form. Any claim made after this deadline will be systematically rejected and will release La Brocante du Chrétien from any liability.

The formulation of this claim to La Brocante du Chrétien can be made by connecting to our site and using our contact form where you will specify, the date of the order, your first and last names and the items ordered.



Article 9: Evidence

The computerized registers, kept in Ma Petite Brocante's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments made between the parties.

The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy.



Article 10: Right of withdrawal

The user has a period of 14 working days to return, at his own expense, the items that do not suit him/her. This period runs from the day of the order.

Any return must be reported in advance to the Customer Service of La Brocante du Chrétien. The product must be returned by registered Colissimo, with insurance on France, and by any means guaranteeing the value in case of loss or breakage.

Information and proof of shipping must be communicated to Catherine ALBERT, La Brocante du Chrétien by the user. These return costs as well as the initial shipping costs are the responsibility of the user.

The returned product must be returned within five days of the notification of the withdrawal to the following address:

After this period of 14 days, if the return shipment has not been made by the user, the exercise of the right of withdrawal is no longer valid and is cancelled, the product is then the property of the user. Only the products returned as a whole, in their original packaging complete and intact (without breakage, cracks, etc.) will be taken back.

The order not picked up by the buyer either at the post office, or in a relay point, or cannot be delivered due to a wrong address, or incomplete address, insofar as we have tried to reach you by email, phone or SMS, will be resent to us at the buyer's expense. The shipping costs related to this return as well as the shipping will be deducted from any refund, as this case is not considered as a WITHDRAWAL or cancellation of the order.



Article 11: Liability

Catherine ALBERT - Brocante du Chrétien cannot be held liable for inconveniences and damages relating to the use of the Internet network, such as a break in the service, the presence of computer viruses or external intrusions or more generally any case qualified as force majeure by the courts.

Article 12: Dispute resolution

In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing this, any legal action will be brought before the competent courts of the defendant's domicile or the jurisdiction of Catherine ALBERT's registered office - La Brocante du Chrétien

These terms and conditions are subject to French law.

Copyright: all the elements constituting the entire www.brocante-du-chretien.fr site are and remain the exclusive intellectual property of Catherine ALBERT (photographs, graphics, texts, logos, creations, database, etc.) No one is authorized to reproduce, exploit, distribute or use the elements of the site, even if they are partially reproduced.
